Expungement Requirements. WHAT ARE THEY?
Note: For MORE INFORMATION, please call the number that has been provided or scan the BAR CODE below.
For Misdemeanor Convictions - (Limit = 2 Expungements)
- All probation/parole requirements have been completed including fines, costs, restitution etc. and are evidenced by the applicable court/agency; AND
- 3 years have passed since conviction; AND
- If the offense was under 49 C.F.R. 383.51 (CDL/ CLP statute), the person was not operating a commercial vehicle or holding a commercial driver's license/learner's permit at the time; AND The conviction is not a violent offense, sex offense, serious traffic offense, or offense involving moral turpitude.
For Felony Convictions: Felony Convictions MUST be pardoned.
ALL OF THE FOLLOWING CONDITIONS MUST BE MET (Limit = 1 Expungement)
- The person is granted a certificate of pardon with restoration of civil and political rights from the Board of Pardons and Paroles; AND
- All civil and political rights forfeited as a result of the conviction have been restored; AND
- 180 days have passed from the date the certificate of pardon was issued; AND
- If the offense was under 49 C.F.R. 383.51, the person was not operating a commercial vehicle or holding a commercial driver's license/learner's permit at the time; AND
- The conviction is not a violent offense, sex offense, serious traffic offence, or offense involving moral turpitude
The following felonies may be expunged if the person can prove that they were a victim of human trafficking AND the offense was committed while they were being trafficked AND they would not have committed the offense but for being trafficked:
- Promoting prostitution in the first degree
- Domestic violence in the third degree
- Production of obscene matter involving a person under the age of 17
- No limit to these expungements
